Background and overview

In the last decade, Teenage Pregnancy (TP) and Child Marriage (CM) have continued to be national challenges in Kenya, as the country still faces a CM rate of 23% and a TP rate of 96/1000. UNFPA (2017) has highlighted that Kenya recorded 378,397adolescent- and teenage pregnancies for girls aged 10-19 years between July 2016 and June 2017. Concurrently, over 13,000 teenage girls drop out of school annually because of pregnancy. Next to CM, Female Genital Mutilation/ Cutting (FGM/C) is another widespread harmful practice taking place in Kenya among 21% of the girls aged 15 to 19.

At the national level, Kenya has clearly outlined its commitment to ending Child Marriage, FGM and increased access and utilization of SRFIR services and access to safe education to young people through a number of policies, guidelines and legal frameworks. The country is however lacking in the efficient implementation of these laws, policies, and national plans of action.

The Break Free programme

The Break Free programme is an initiative of Plan International Netherlands, SRHR Africa Trust (SAT) and Forum for African Women Educationalists (FAWE) in collaboration with the technical partners The Royal Tropical Institute KIT’ and ‘Rozaria Memorial Trust’ (RMT)1 in Kenya, the Programme is implemented by a consortium of three organisations namely: Plan International Kenya, Forum for African Women Educationalist (FAWE) and SRHR Africa Trust (SAT). The 5-year programme that spans January 2021 to December 2025 is implemented in Kajiado, Tharaka-Nithi and Tana River Counties as well as the national level aims to support adolescent girls to exercise their right to live free from FGM, Teenage Pregnancy (TP) and Child Marriage (CM), supported by civil society. The programme has the following three outcomes; Outcome 1: Adolescent girls at risk of CM/TP and FGM/C have access to quality education in a safer school environment with improved participation, retention and completion Outcome 2: Duty Bearers and decision makers at national and county level, review, resource and implement laws and policies that respond to adolescents’ needs. Outcome 3: Adolescent girls and boys access quality SRHR education, information and youth friendly services.

The Consultancy Objective

The programme aims to conduct a policy and legal landscape analysis to review the legal and policy environment in Kenya in relation to SRHR, FGM and Child Marriage in Kenya. The findings and recommendations will inform on the advocacy and influencing strategy for the programme at the national and county level.
