INVITATION TO TENDER 

CONSTRUCTION OF THE MAU MAU LOT 4: IHITHE – NDUNYU NJERU ROAD PROJECT

TENDER NO. KeNHA/2611/2022

The Kenya National Highways Authority (KeNHA) is a State Corporation established under
the Kenya Roads Act, 2007, with the responsibility for the management, development,
rehabilitation and maintenance of national roads.
The Authority invites bids from eligible construction companies registered with the
National Construction Authority (NCA) in Category NCA 1 for the CONSTRUCTION OF
THE MAU MAU LOT 4: IHITHE – NDUNYU NJERU ROAD PROJECT to be funded by the
Government of Kenya through the Development Fund.
SCOPE OF WORK
The scope of works shall be as described in the tender document.
QUALIFICATIONS FOR TENDERING

Mandatory Requirements
The following MUST be submitted together with the tender;
1. Copy of Certificate of Incorporation or Certificate of Compliance for Foreign
Contractors
2. Copy of Valid Annual Practicing Licence with the National Construction Authority in
the class specified above for Citizen Contractors.
3. Copy of Valid Tax Compliance Certificate
4. Copy of recent CR 12 form provided by the Registrar of Companies during the time of
registration or its equivalent for international firms that shows the list of
directors’/ownership structure.
5. Bidders shall sequentially serialize all pages of each tender submitted.
6. All foreign contractors MAY enter into a Joint Venture (JV) with a Citizen Contractor
where at least forty percent of work in terms of value shall be undertaken by a Citizen
Partner. A fully registered JV agreement executed according to the Registration of
Documents Acts must be submitted together with their tender. This requirement will
form part of the Contract.
7. Bidders must sequentially serialize all pages for each bid document submitted.
NOTE: All Certification of Documents shall be original and executed by a Commissioner for
Oaths or Notaries Public.

Other Requirements
As specified in the respective Tender Documents covering the following: –
1. Similar previous experience
2. Equipment holding as per Appendix 1
3. Professional and technical personnel
4. Current work load
5. Litigation history (Current Sworn Affidavit, i.e., within three months of the tender
opening date)
6. Eligibility
a) Only those bidders registered in the NCA 1 category as indicated in the tender
document shall bid as a Single Domestic bidder or as Lead Foreign Partner in a JV
with a domestic partner.
b) Bidders with history of Non-performance (e.g., failure to complete the projects for
the last three (3) Financial Years, notice of termination or termination of contracts
in the last three (3) Financial Years will be disqualified.
c) Director’s bidding under different companies for the same tender shall be
disqualified.
d) For Joint Ventures (JV), evidence of a duly executed Joint Venture Agreement by
both parties and registration of the same with the Registration of Documents Act.
8. Any form of canvassing will lead to disqualification.
Note:
 In case of a joint venture (JV), the above mandatory requirements shall be met by all
joint venture partners. For domestic JV partners, the NCA category requirements shall
be either NCA 1, or 2, or 3
 Procurement shall be based on the post qualification method and the above details will
be submitted with the priced bid.
 All submitted Documents may be verified from the issuing agencies, KeNHA Reserves
the right to verify all submitted documents
There shall be a mandatory pre-tender site visits on 25th August, 2022 at 10:00 am at
Ihithe Shopping Centre, Nyeri County.
However, interested bidders are free to visit the sites on their own to familiarise themselves
with the site condition of the intended road works.
Interested eligible candidates may obtain further information and inspect tender documents
from the Kenya National Highways Authority Headquarters, Barabara Plaza as detailed in
the Advertisement, from 09th August, 2022 during normal working hours.

A complete set of tender documents may be obtained by interested tenderers from the Kenya
National Highways Authority website: www.kenha.co.ke or PPIP portal: www.tenders.go.ke
free of charge. Bidders are encouraged to download tender documents to minimise physical
visits to KeNHA Headquarters Office.
Completed tender documents are to be enclosed in plain sealed envelope clearly marked
with tender name, reference number and submitted to: –

Jomo Kenyatta International Airport (JKIA), Nairobi, Off Mazao Road,
Block C – 2nd Floor Board Room.
All interested bidders are required to continually check the Kenya National Highways
Authority website: www.kenha.co.ke for any tender addendums or clarifications that may
arise before submission date on 20th September, 2022.
Tenders will be opened immediately thereafter in the presence of Tenderers/Representatives
who wish to attend at the Kenya National Highways Authority Headquarters, Barabara
Plaza, Jomo Kenyatta International Airport (JKIA), Nairobi, Off Mazao Road, Block C – 2nd
Floor Board Room.
