CONSULTANCY SERVICES – BASELINE SURVEY FOR THE CULTIVATING JUSTICE PROJECT

A key part of DCA’s innovation journey is learning; however much of this is focused on celebrating successes, with less time invested in reflecting on (missed) opportunities and key reflections on cultural and organisational systems and structures needed to fully support DCA’s innovation ambitions.
Consultancy services needed:
The consultancy is aimed to;
1. Assess the Capacity of Civil Society Organizations (CSOs) and Grassroots Organizations
a. Identify existing capacities, tools, and resources available for monitoring and reporting human rights violations in the agribusiness sector.
b. Examine the challenges faced by CSOs and human rights defenders (HREDs) in conducting monitoring and advocacy activities in business and human rights.
2. Evaluate the Utilization of Judicial and Non-Judicial Grievance Mechanisms (NJGMs)
a. Assess the level of awareness, access to and utilization of NJGMs among affected communities independently and/or with the support of civil society.
b. Identify barriers preventing aggrieved parties from accessing NJGMs.
c. Examine the effectiveness of existing NJGMs in providing redress for human rights violations in the agribusiness sector.
3. Analyze the Engagement of Duty-Bearers (Government and Private Sector)
a. Assess the existing systems and platforms that facilitate engagement on business accountability, human rights, and environmental due diligence.
b. Examine the responsiveness of government and private sector actors to advocacy efforts by CSOs and affected communities.
c. Identify obstacles that hinder meaningful dialogue and action regarding human rights abuses in the agribusiness sector.
4. Measure Awareness and Adoption of Key Human Rights Policies
a. Establish the current level of awareness among stakeholders regarding the UN Guiding Principles on Business and Human Rights (UNGPs), the EU regulation on human rights and environmental due diligence (HREDD) including the EU Corporate Sustainability Due Diligence Directive (CS3D), sustainability reporting (CSRD) and the EU Deforestation

Regulation (EUDR) as well as guidelines such as ILO Policy Guidelines for the promotion of decent work in the agri-food sector. b. Assess the extent to which agribusiness companies and government institutions have implemented measures to comply with these frameworks.
c. Identify key challenges and recommendations to the adoption and enforcement of these human rights policies.
5. Identify Opportunities for Enhancing Project Efficiency, Impact, and Sustainability
a. Map out existing platforms, partnerships, and resources that can be leveraged to enhance the efficiency of project implementation.
b. Identify enabling and hindering factors that could influence the project’s long-term impact on responsible business conduct.
c. Examine mechanisms to ensure the sustainability of CSO-led monitoring efforts and broader accountability initiatives beyond the project duration.
Geographical area of the assignment is Nakuru, Nyandarua and Nairobi Metropolis and travelling to the sites during engagement is anticipated.

Provide the following information (mandatory documents)
• Brief company profile with the company’s brief background, name, contact details and physical address.
• Company’s statutory documents (Certificate of registration or incorporation, CR12 and KRA Pin)
• A brief word document summary of the skills and experience of the proposed lead consultant and the consultant(s) showing briefly the relevant previous assignments and education level. Maximum, 3 pages.
• At least three recommendation/reference letters.
The Evaluator must have the following expertise and qualifications:
• Lead consultant with at least a master’s degree in law, social sciences, project management, development studies, or related fields.
• The firm should have at least 5 years of experience in evaluating development programs, particularly in the business and human rights space.
• Proven experience working in business and human rights, programming and advocacy for human rights and knowledge of the legal and regulatory frameworks relevant to human rights and agriculture in Kenya.
• Strong expertise in quantitative and qualitative data collection and analysis.
• Demonstrated knowledge of OECD/DAC evaluation criteria.

Only Kenyan firms will be considered.
Individual consultants will not be considered.
