  1. Background

The Government of Kenya has received financing from the World Bank toward the cost of the National Agricultural and Rural Inclusive Growth Project (NARIGP), and intends to apply part of the proceeds for consulting services. NARIGP is a 5 year USD 200 million, World Bank supported project whose Development Objective is “to increase agricultural productivity and profitability of targeted rural communities in selected Counties, and in the event of an Eligible Crisis or Emergency, to provide immediate and effective response” NARIGP is jointly implemented by National Government through the State Department for Crop Development and Agricultural Research in the Ministry of Agriculture, Livestock, Fisheries and Cooperatives and 21 participating County Governments. NARIGP has the following three main thematic Components;

  1.             Supporting Community-Driven Development
  2.             Strengthening Producer Organizations and Value Chain Development

                              iii.            Supporting County Community-Led Development

Under Component 3 that supports County Community-led Development, the National Technical Advisory Committee (NTAC) for NARIGP has approved a to­tal of 120 Multi-Community Investments (MCls) across the 21 counties with an estimated cost of KES 5.7 billion. These investments are mainly focusing on agriculture rural infrastructures such as agro-processing plants and land­scape-wide watershed management for example water harvesting pans and irrigation schemes. The MCls are expected to contribute to the Government’s high-level objective, of transforming smallholder subsistence agriculture into an innovative, commercially oriented, and modern sector by: (i) increasing the productivity, commercialization, and competitiveness of selected agricultural commodities; and (ii) developing and managing key factors of production, par­ticularly land, water, and rural finance.

Consistent with its corporate environmental policy, NARIGP intends to pre-qual- ify consultancy firms for the preparation of Environmental and Social Safeguard (ESS) study reports for its MCls in accordance with the Environment Manage­ment and Coordination Act (1999) and World Bank Guidelines and Internation­al Best Practices

  1. Objectives.

The purpose of this assignment is to expedite preparation of ESS study reports.

  1. Scope of Work & Service

The consulting services (“the Services”) include but not limited to, preparing ESS study reports in close collaboration with participating Counties in accor­dance with EMCA 1999 and Environmental (Impact Assessment & Audit) Regu­lations 2003. The respective reports will be submitted to the NPCU for onward submission to World Bank and finally NEMA for license issuance. The ESS team will be required to assess the impacts of the proposed development on the social and environmental integrity. The salient features of an ESS study report as provided in EMCA and EIA/EA Regulations include:

  1. a)The proposed location of the project
  2. b)A concise description of the national environmental legislative and regulatory framework, baseline information, and any other relevant information related to the project
  3. c)The objectives of the project
  4. d)The technology, procedures and processes to be used, in the imple­mentation of the project
  5. e)The materials to be used in the construction and implementation of the project
  6. f)The products, by-products and waste generated by the project
  7. g)A description of the potentially affected environment
  8. h)The environmental effects of the project including the social and cul­tural effects and the direct, indirect, cumulative, irreversible, short-term and long-term effects anticipated
  9. i)Alternative technologies and processes available and reasons for pre­ferring the chosen technology and processes
  10. j)Analysis of alternatives including project site, design and technologies and reasons for preferring the proposed site, design and technologies
  11. k)An environmental management plan proposing the measures for elim­inating, minimizing or mitigating adverse impacts on the environment; including the cost, time frame and responsibility to implement the measures
  12. l)Provision of an action plan for the prevention and management of foreseeable accidents and hazardous activities in the case of carrying out activities or major industrial and other development projects
  13. m)The measures to prevent health hazards and to ensure security in the working environment for employees and for the management of emergencies
  14. n)An identification of gaps in knowledge and uncertainties which were encouraged in compiling the information
  15. o)An economic and social analysis of the project
  16. p)An indication of whether the environment of any other state is likely to be affected and the available alternatives and mitigating measures and
  17. q)Such other matters as NARIGP may require including public consulta­tion with various stakeholders through focus group meetings.

The ESS team will also assess the impacts of the proposed development on the following as provided for by the second schedule to the Environmental (Impact Assessment and Audit) Regulations, 2003:

  1. a)Biological diversity
  2. b)Ecosystem maintenance
  3. c)Surface water quality
  4. d)Ground water quality
  5. e)Soil contamination
  6. f)Social consideration such as economic impacts, social cohesion or disruption
  7. g)Effects on human health including air and noise qualities
  8. h)Effects on the current land uses and land use potentials and
  9. i)Landscape entailing compatibility with the surrounding area
  10. j)Air quality.
  11. Shortlisting Criteria

NARIGP now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide infor­mation demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are:

  1. Must be NEMA registered firm of ESIA/EA experts.
  2. Valid practicing license for the firm of ESIA/EA experts
  3. Demonstrated experience in the supervision and implementation of Corporate Social Responsibility activities/works generated from Envi­ronmental & Social Impact Assessment (ESIA) processes
  4. Demonstrated availability of technical staff, with the team lead having fifteen (15) years or more of experience in undertaking ESS Studies for the agriculture and natural resource management sector.
  5. Valid Tax Compliance Status of the bidder in the Country of Origin
  6. Evidence of experience (minimum 10 years) in preparation of ESS study reports that meet World Bank Standards
  7. At least three (3) references of similar work done in the last five years
  8. Key Experts will not be evaluated at this stage.

The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers, January 2011 Re­vised July 2014 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.

Consultants may associate with other firms in the form of a joint venture or a sub-consultancy to enhance their qualifications. All the members of the joint venture shall be jointly and severally liable for the entire assignment. However, the experience of sub-consultant will not be considered while short-listing.

A Consultant will be selected in accordance with the Selection Based on the Consultants’ Qualifications (CQS)%method set out in the Consultant Guidelines.
