REQUEST FOR EXPRESSION OF INTEREST (EOI) FOR CONSULTANCY SERVICES FOR REVIEW OF THE WILDLIFE CONSERVATION AND MANAGEMENT ACT, NO. 47 OF 2013

  1. Background

The Ministry of Tourism and Wildlife, State Department for Wildlife wishes to engage the services of a Consultant to carry out a comprehensive review of the Wildlife Conservation and Management Act, No. 47 of 2013.

  1. Objective

The objective is to undertake a comprehensive review of the Wildlife Conservation and Management Act, 2013 (No. 47 of 2013) and develop a draft Bill of the same.

  1. Consultant Responsibilities/Tasks
  2.             Undertake a comprehensive review and analyze the existing legal framework and identify the weak­nesses, shortcomings and the gaps in the existing Wildlife Conservation and Management Act (No. 47) of 2013;
  3.             Study the new Wildlife Policy 2020 and identify aspects to be included in the New Wildlife Bill;

      iii.            Conduct a comparative analysis of wildlife laws (statutes) and provide recommendations in line with best international practices;

  1.             Prepare and present a comprehensive work plan for the development of draft Bill, including the consultative process, and resultant budgetary expectations for approval;
  2.             Implement the approved Work Plan;
  3.             Using the results of i – v above, prepare and present the Wildlife Conservation and Management draft Bill 2020 to the Ministry of Tourism and Wildlife.
  4. Eligibility criteria

Interested individual consultant should have a PhD in Environmental Law, be an Advocate of the High Court of Kenya with at least 15 years relevant experience, should have good communication skills, have ability to work collaboratively with diverse teams, have excellent problem solving skills, have ability to work within tight dead­lines, demonstrate experience in similar assignments within the natural resources Sector, and has published at least five (5) relevant papers/articles in Internationally recognized Journals.

The consultant should provide a pin and a valid tax compliance certificate.

Selection of the Consultant will be in accordance with procedures set out in the Public Procurement and Dis­posal Act, 2015 and the Public Procurement and Disposal Regulations, 2020.

Interested Consultants may obtain the Terms of Reference from the Ministry of Tourism and Wildlife website (www.tourism.go.ke) or the National Treasury suppliers’ portal (www.treasury.go.ke).

Duly completed expression of interest documents in plain sealed envelopes clearly marked “Provision of Con­sultancy Services for Review of the Wildlife Conservation and Management Act, 2013” and bearing no indication of the identity of the Consultant should be addressed to The Principal Secretary,

State Department for Wildlife,

  1. O. Box 41394 – 00100,

and be deposited into the tender box at the reception of State Depart­ment for Wildlife, NSSF Building, Block-A, Eastern Wing, 15th Floor, on or before 12:00 Noon, on 12th August, 2020.

Bids will be opened immediately thereafter in the presence of Consultants or their representatives who choose to attend.
